Rules for the 2016 Tanguay House draw

TOTAL PRIZE VALUE: $705,500

The ticket provides three (3) chances to win one of the twenty-five (25) prizes that will be awarded in the Grand Draw on September 18, 2016. The twenty-five (25) winning tickets will be randomly pre-selected on one of the dates below and deposited in a barrel specifically for the Grand Draw.

1. Pre-selection of 10 winners-finalists on April 22, 2016, at 9 a.m. at Ameublements Tanguay's head office located at 7200 Armand-Viau Street in Quebec City. To be eligible for this pre-selection, purchase your ticket before April 18, 2016.

2. Pre-selection of 5 winners-finalists on July 8, 2016, at 9 a.m. at Ameublements Tanguay's head office located at 7200 Armand-Viau Street in Quebec City. To be eligible for this pre-selection, purchase your ticket before July 4, 2016.

3. Pre-selection of 10 winners-finalists on September 9, 2016, at 9 a.m. at Ameublements Tanguay's head office located at 7200 Armand-Viau Street in Quebec City. To be eligible for this pre-selection, purchase your ticket before September 5, 2016.

THE GRAND DRAW WILL TAKE PLACE ON SEPTEMBER 18, 2016 AM, ON THE PROGRAM SALUT BONJOUR WEEKEND, ON TVA À QUÉBEC:

All twenty-five (25) capsules of the pre-selected winners will be placed in the winners' barrel (barrel #1). A second barrel (barrel #2) will contain the 23 capsules representing each of the prizes listed below, with the exception of the House and the car, which will all be awarded at random.

Step 1 - Two capsules are randomly selected from the winners' barrel (barrel #1) by the draw manager. These represent the grand prize winner of the House as well as a winner of a 2016 Mercedes-Benz CLA 250 valued at $40,000 including taxes, preparation and transportation, which will only be revealed at the very end of the draw. Registration, insurance, gas and maintenance of the vehicle are at the winner's expense.

Step 2 - Each winner is drawn in turn from the winners' barrel (barrel #1) by the draw manager. Once selected, the winners or their representatives* draw from the prize barrel (barrel #2) a capsule corresponding to the prize they will be awarded.

Step 3 - Finally, the last capsule (23rd) in the winners' barrel (barrel #1) will receive the last remaining prize in the prize barrel (barrel #2).

Step 4 - When there are no more capsules left in the winners' barrel (barrel #1), the person in charge of the draw will pick one of the two capsules set aside at the very beginning of the draw (in step 1) which will first reveal the name of the grand prize winner of the 2016 Tanguay House. The last remaining capsule will designate the winner of the 2016 Mercedes-Benz CLA 250, valued at $40,000.

*If the winner is not present at the time of the grand draw, the Maurice Tanguay Foundation will designate a representative who will act on his behalf. This representative will pick a capsule, at random from barrel #2, corresponding to the prize that will be awarded to the winner he/she represents.

The prize barrel (barrel #2) will contain 23 capsules including the following 23 prizes:

  • Eight $1,000 gift certificates redeemable at Canadian Tire before March 31, 2017;
  • Five $2,000 gift certificates redeemable at Qualinet before March 31, 2017;
  • Five $3,000 gift certificates redeemable at Latulippe before March 31, 2017;
  • Five $5,000 gift certificates redeemable at Ameublements Tanguay before March 31, 2017;

The 24th and 25th prizes (to be awarded to the winners selected in step 1): Among the 2 capsules set aside in step 1, the first one randomly selected will designate the grand prize winner who will have the choice of either the House Everywhere in Quebec Prize or the $500,000 Silver Prize (25th prize). The remaining capsule will designate the winner of the 24th prize, a 2016 Mercedes-Benz CLA 250 automobile, valued at $40,000.

For your information, the Home Award everywhere in Quebec*, includes (total value of $607,500 taxes included) :

  • The construction of a house with a total value of $400,000
  • An allowance of $100,000 for the land and landscaping in a municipality of your choice in Quebec.*
  • The furniture and decoration worth $52,500.
  • In addition, for a period of 5 years, the winner will be entitled to the following benefits: property and school taxes, electricity, heating, telephone service subscription as well as notary fees for the transaction (value of $55,000).

*The winner will be able to receive this house in the municipality of his choice in Quebec only. However, the land chosen must be served by public and municipal services (electricity, water supply, etc.) and qualified labour must be available in the region concerned in order to carry out this project. The Maurice Tanguay Foundation's responsibility cannot exceed $607,500, all taxes included, for the realization of this project.

The winner may also choose the Silver Award. If the winner chooses the Silver Award, the Maurice Tanguay Foundation will award the sum of $500,000.

The winner will have 15 days from the date of the draw to choose between the House Prize and the Silver Prize, in order to award the House to the winner in a timely manner, if applicable.

Number of bills in circulation: 220,000 $10 bills numbered from 100,001 to 320,000.

The draws will be supervised by Raymond Chabot Grant Thornton.

All winners will be announced in the Journal de Québec, the electronic media and on the websites www.fondationmauricetanguay.com and www.maisontanguay.com.

The Maurice Tanguay Foundation will contact the winners within 48 hours of the draw date. The winners will have 30 days, after September 18, 2016, to claim their prize from the Maurice Tanguay Foundation, 4815 de l'Ormière Blvd, Suite 280, Quebec City, Quebec, G1P 1K6, telephone (418) 627-5527, fax (418) 627-2098. Prizes are non-transferable, non-redeemable and non-exchangeable. Winners must take possession of the prizes as described in the rules.

A winner must consent, if requested and without compensation, to the use of his/her name, photograph, voice, place of residence and/or any statement related to the prize being awarded for publicity purposes related to this contest.

Any dispute will be submitted to the Régie des alcools des courses et des jeux for a final decision.

Restriction: To participate in this lottery, you must be 18 years of age or older. Members of the Board of Directors of the Maurice Tanguay Foundation and their spouses cannot participate in these draws.

DESCRIPTION OF THE 5 YEAR NO CHARGE

1. The Foundation provides the Winner with a package of home-related benefits for a period of five (5) years (hereinafter referred to as "The 5-Year Free").

The Winner will take possession of the property when the Foundation deems the construction of the House to be completed to the Winner's satisfaction, and the beginning of the 5-year no-cost period will be the date the keys to the House are physically handed over by the Foundation to the Winner (hereinafter referred to as the "Possession Date"). The Foundation assumes no responsibility for any delay caused by any event beyond its control including but not limited to strikes, fire, explosion, etc.

2. In this document, the term "year" means twelve (12) months from the date of taking possession of the house.

3. The benefits offered are as follows:

MUNICIPAL AND SCHOOL TAXES

The Foundation will pay the cost of municipal and school taxes for a maximum amount and a maximum period of sixty (60) months from the date the Winner takes possession of the house. The Winner must present his tax bills to the Maurice Tanguay Foundation office and the Foundation will pay these bills, without exceeding the maximum amount.

The maximum amount paid per year by the Foundation will be six thousand three hundred and sixty dollars ($6,360) for a period of 5 years from the date of taking possession of the House, for a grand total maximum of thirty-one thousand eight hundred dollars ($31,800).

If the last year of the 5-year free ride ends prior to December 31 of the current calendar year, a fee adjustment will be made accordingly between the Foundation and the Winner.

Should the Winner add any outbuildings to the property, such as a pool, shed, etc., and these additions increase the assessment of the property, the Foundation will not be responsible for the payment of any additional taxes generated by these improvements and the Winner will be responsible for paying the taxes for the portion of the improvements made.

To be eligible for this benefit, the Winner must live in the 2016 Tanguay House. This benefit is refundable as per clause 6 of this document.

ELECTRICITY AND HEATING

The Winner shall present his electricity bills to the Maurice Tanguay Foundation office and the Foundation shall pay these bills, taking into account the study/evaluation made by Hydro-Quebec for the Foundation, which shows that a maximum amount of four thousand five hundred ($4,500) per year, all taxes included, is sufficient to cover the cost of electricity, including the heating of the house. The maximum amount paid by the Foundation will therefore be limited to this amount, for a period of five (5) years, starting from the date of taking possession of the house, for a grand total maximum of twenty-two thousand five hundred dollars ($22,500).

The Foundation delivers to the winner a single-family home with no outbuildings. It is understood that any excess electricity and heating costs required for outbuildings, such as a pool, shed, etc., or modifications made to the building by the Winner that increase the cost of electricity and/or heating of the property above the maximum amount will be the responsibility of the Winner or the owner.

To be eligible for this benefit, the Winner must live in the 2016 Tanguay House. This benefit is refundable as per clause 6 of this document.

TRANSFER OF OWNERSHIP

The transfer of title to the property to the Winner will be made before a notary from the firm of Gosselin, Lagueux, Roy in Levis and all costs will be borne by the Foundation (value of $700).

4. In the event of the death of the Winner during the 5-year free period, the Foundation may require that only one (1) person be involved and the owners will be required to appoint an agent to represent them with the Foundation.

5. The Foundation reserves the right to pay in one (1) installment, at any time during the 5-year free period and at its sole discretion, the amount of the Foundation's estimate (see clause 6 below) of the cost of the benefits offered or any unpaid balance at the time of payment, and the homeowner shall give final release of all obligations to the Foundation.

6. In the event that the Foundation applies clause 5, the Foundation will compensate the Winner with a cheque for the value of the tax and heating benefits according to the table below:

1st year: $55,000
2nd year: $44,000
3rd year: $33,000
4th year: $22,000
5th year: $11,000

less any amounts incurred by the Foundation for such services since the beginning of the year in which the sale is to take place, which is accepted by the Winner, with final release by the Winner to the Foundation of all obligations to the Winner, upon receipt of the agreed amount.


7. Notwithstanding the conditions listed above, the Foundation also offers the Winner the option of releasing the Foundation from its 5-year obligations at no cost in consideration of the payment of fifty-five thousand dollars ($55,000 ) upon signing the notarized contract. In this case, the Winner will have to give the Foundation a final release of all its obligations, thus freeing the Foundation from all its commitments towards the Winner and any eventual buyer.
